Buying a home in a Florida Homeowners Association (HOA) involves signing paperwork acknowledging the governing documents. That signature doesn’t mean anyone read them. Owners who did read them may still miss that a “maintained appearance” standard can mean a lawn kept up every week. Florida HOA exterior inspections protect home values and quality of life by holding every home to the same standard, and they often expose that gap. At Synergistic Community Association Management, an inspector who has studied the governing documents walks every street, and your Licensed Community Association Manager (LCAM) brings any dispute to the board.
Highlights
- Synergistic Community Association Management, a certified woman-owned firm based in Tampa, conducts inspections based on the specific DCC&Rs and governing standards established for each community.
- Under FS 720.3035(1)(a), inspections and enforcement of exterior standards are conducted in accordance with each community’s governing documents and must be applied reasonably and equitably among owners.
- A fine requires 14 days’ written notice of the right to a hearing, and a violation cured before the hearing cannot be fined, per FS 720.305(2)(b) and (e).
- Before either side files suit over a covenant enforcement dispute, FS 720.311(2)(a) requires a written demand for presuit mediation.
What does a Florida HOA exterior inspection check?
On a schedule established for each community, the inspector reviews properties for compliance with the community’s specific DCC&Rs and governing standards. The inspection covers only what the declaration addresses and what is visible from the street, a neighboring lot, or common areas.
Lawn/landscaping are where there is more room for judgment. Owners tend to think of the yard as theirs to keep as they please, and some declarations draw the line at a weekly maintained-appearance standard. The inspector’s notes record what they saw and where, so the same yard gets the same call every time.
Why are owners caught off guard?
Each new member must receive a copy of the rules and covenants under FS 720.303(15)(b). Synergistic posts each community’s governing documents in its owner portal, where owners can read them at any time. Renters are bound by the same documents under FS 720.305(1) but may never see them, so boards should ask landlords to share them.
A plain-language summary of exterior standards, posted before inspections begin, helps owners understand what they signed for. Where the declaration uses an open standard, a board rule can define it, such as a maximum grass height, if the governing documents allow it.
When an owner pushes back
Owners see violation notices in the portal and document cures there. When an owner insists that nothing is wrong or refuses to act, the board decides whether to involve the association’s attorney, based on the inspector’s notes and the portal record.
If a fine is proposed, the Association follows the enforcement procedures outlined in the community’s governing documents and applicable Florida law. A hearing committee of at least three eligible members reviews the proposed fine, and fines of less than $1,000 may not become a lien. When necessary, legal counsel assists the Board in following the proper procedures before a matter advances to mediation or court.
